# Terms of Service **Last updated: 2026-05-11** Welcome to Roundhouse South. These Terms of Service ("Terms") govern your use of our website, store, and services. By visiting our website or placing an order, you agree to these Terms. Who We Are Roundhouse South is a model train hobby shop owned and operated as a sole proprietorship in the State of Florida. We have served the model railroading community since August 1989. Throughout these Terms, "we," "us," and "our" refer to Roundhouse South. "You" refers to anyone using our website or buying from us. ## 2. Eligibility You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order on our website. By placing an order, you represent that you meet this requirement. ## 3. Products and Pricing We sell model trains, accessories, and related hobby products from manufacturers including Lionel, MTH, Atlas, Bachmann, Walthers, Woodland Scenics, and others. We make every effort to display product information, photos, and prices accurately. However: - Prices are subject to change without notice - Product availability is limited to current stock and may change without warning - We reserve the right to correct typographical errors, including pricing errors, and to refuse or cancel orders affected by such errors - Manufacturer photos may not exactly match the product you receive (paint scheme variations, road numbers, packaging changes) - Compatibility with your existing layout, scale, or control system is your responsibility — please verify before purchase ## 4. Orders, Payment, and Acceptance When you place an order on our website, you are making an offer to buy. We accept your offer when we charge your payment method and ship your order. We may refuse or cancel any order at our discretion, including (but not limited to) suspected fraud, pricing errors, or out-of-stock items. Payment is processed at the time of order through Shopify Payments and approved third-party processors. We accept major credit cards and digital wallets supported at checkout. ## 5. Sales Tax Florida sales tax is collected on orders shipped within Florida and on in-store pickup orders, as required by Florida law. Out-of-state orders may also be subject to sales tax depending on the destination state's economic nexus rules. ## 6. Local pickup at our Port Orange showroom is available — see the Shipping Policy for details. ## 7. Returns and Refunds Return terms are described in our [Refund Policy](/policies/refund-policy). Manufacturer warranties are handled separately — see Section 11 below. ## 8. Authorized Dealer Status Roundhouse South is an authorized dealer for several manufacturers, including Lionel and MTH. "Authorized dealer" means we are recognized by the manufacturer as a legitimate retailer of their products and that products purchased from us qualify for the manufacturer's standard warranty. It does not mean we are an agent of the manufacturer or that we speak on their behalf. ## 9. Intellectual Property The Roundhouse South name, logo, website design, photographs, and original content are owned by Roundhouse South. Manufacturer product names, trademarks, photographs, and descriptions remain the property of their respective owners. We use them with permission or under fair-use principles for the purpose of selling those products. You may not reproduce, copy, or republish content from our website for commercial purposes without written permission. ## 10. Customer Reviews If you submit a product review, comment, or other content to our website, you grant us a non-exclusive, royalty-free license to display and use it for promotional purposes. You agree that any content you submit: - Is your own original content (or content you have permission to share) - Is not defamatory, obscene, or otherwise unlawful - Does not violate any third-party rights - Reflects your honest opinion or experience We reserve the right to edit or remove reviews at our discretion. ## 11. Manufacturer Warranties Most products we sell come with a manufacturer warranty. Warranty claims (defective products, electronics failures, broken parts within the warranty period) are handled by the manufacturer, not by Roundhouse South. If you have a warranty issue, contact us first — we'll help you understand the warranty terms and connect you with the right manufacturer service center. For Lionel and MTH products, we operate a service center on-site and may be able to help directly. For other manufacturers, we'll point you to their service contact. ## 12. Disclaimer of Warranties Our website and products are provided "as is" and "as available." We do not warrant that: - Our website will be uninterrupted, error-free, or free of viruses - Product photos will exactly match what you receive - Products will meet your specific requirements or expectations beyond what the manufacturer specifies To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law. ## 13. Limitation of Liability To the fullest extent permitted by law, Roundhouse South's total liability for any claim arising from your use of our website or products is limited to the amount you paid for the product(s) at issue. We are not liable for indirect, incidental, special, consequential, or punitive damages, including (but not limited to) loss of profits, loss of data, or damage to other property arising from product use. This limitation does not apply where prohibited by law, including in cases of gross negligence, willful misconduct, or violations of consumer protection statutes. ## 14. Indemnification You agree to indemnify and hold Roundhouse South, its owner, employees, and agents harmless from any claim or liability arising from your misuse of our website, your violation of these Terms, or your violation of any third-party rights. ## 15. Governing Law and Disputes These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of our website will be resolved in the state or federal courts located in Volusia County, Florida. You agree that any claim must be brought within one (1) year of the event giving rise to the claim, or it is permanently barred. ## 16.
